Between the 1840’s and the 1870’s, many treaties were signed between the indigenous peoples of North America and the governments of Canada and the US. In these treaties, the groups of native people typically ceded lands and passage rights to the US. In turn, most of these treaties outlined the rights of tribes to retain access to traditional hunting, fishing, and gathering locations. Later (primarily in the 1960’s and 1970’s), several court decisions formally interpreted the treaties’ definition for the amounts of a particular resource that a tribe owned (i.e. 50% of the salmon runs in any given year).
Nonetheless, treaty rights continue to be challenge-d. The challenges typically involve water rights and salmon harvests.
Write about the Medicine Creek Treaty and identify what parties were involved, what was the content of the treaty, and what was granted to the signing parties. The power dynamics of the groups at the negotiating table was an important variable at the time, and that dynamic continues in many forms today. For this discussion, I want you to reflect on what you would do if you were an advisor for the tribe participating in the treaty negotiation. What would you have recommended be included in a treaty that would that would have created a better future for tribal members? Explain why you would include those items.
